 [Cautions] 4PX knows very well the significance of personal information to you, and attaches great importance to protection of the user’s personal information. 4PX will take appropriate security protection measures to protect your personal information, and endeavor to guarantee that your personal information is safe and controllable pursuant to the laws and regulations. When you use the services provided by 4PX, 4PX will collect, use, share, store and protect your personal information in accordance with this Privacy Policy.

This Privacy Policy contains terms and conditions in connection with collection, use, sharing, storage and protection of your personal information. 4PX wishes to clearly introduce its processing way of your personal information through this Privacy Policy. Thus, 4PX recommends that you carefully, completely and thoroughly read and understand this Privacy Policy before you use the services of 4PX Client, so as to know how to protect your privacy.

If you disagree with this Privacy Policy or any contents hereof, you may refuse to use the services of 4PX; if you refuse to provide your relevant personal information while using the services of 4PX, you might be unable to use the services of 4PX normally.

I. Definitions

1.1 4PX Client: shall refer to the official website of 4PX (domain name: [https://www.4px.com]) and programs, systems, applications, websites, client terminals and other corresponding equipment for providing the services.  

1.2 4PX: shall individually or collectively refer to the operators or service providers of 4PX Client, including but not limited to Shenzhen 4PX Express Co., Ltd. and its affiliates.

1.3 Personal Information: shall refer to the information, contents or data that is recorded in electronic or other forms and can identify the status of specific natural person or reflect activities of the specific natural person independently or together with other information.

1.4 Except otherwise agreed, the definitions used herein shall have the same meanings as the definitions used in the 4PX User Agreement.

II. Scope of Application

2.1 4PX keeps providing better and more personalized services to the users. 4PX collects, stores, uses, shares and protects your personal information in order to provide better and more personalized services to you, and hope that you could enjoy more convenient life via 4PX’s services. This Privacy Policy is applicable to all services of 4PX Client. Your access to 4PX Client and/or login to relevant client terminals to use the services of 4PX Client shall be subject to this Privacy Policy. Unless otherwise agreed herein, or 4PX account or 4PX affiliates’ account is used in the services of 4PX but no independent privacy policy is established, this Policy shall also be applicable to such services.

 

2.2 [Special Notice] This Privacy Policy does not apply to any services provided by a third party to you, e.g., when the enterprise engaging in express business entrusts 4PX Client to provide services to you, this Privacy Policy shall not be applicable to the personal information provided by you to the enterprise engaging in express business.

2.3 [Users of European Economic Area (EEA)]

If you are in the EEA your controller is Shenzhen 4PX Express Co., Ltd (incorporated in Mainland China). For contact details, please see section “Contact Us” below.

 

INTERNATIONAL TRANSFERS OF PERSONAL DATA

 Our business may require us to transfer your personal data to countries outside of the EEA, including to countries that may not provide the same level of data protection as your home country such as China. We take appropriate steps to ensure that recipients of your personal data are bound to duties of confidentiality and we implement appropriate measures to ensure your personal data will remain protected in accordance with this Privacy Policy, such as standard contractual clauses.

 

YOUR RIGHTS 

If you are a resident of the EEA, you have the following data protection rights, which you can exercise at any time by contacting us using the contact details provided under section “Contact Us” below:

 •      The right to access, correct, update or request deletion of your personal data.

•      The right to object to processing of your personal data when it is based on our legitimate interests, and separately the right to object to direct marketing.

•      The right to ask us, in some situations, to restrict processing of your personal data or request portability of your personal data.

•      The right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing e-mails we send you. To opt-out of other forms of marketing (such as postal marketing or telemarketing), then please contact us using the contact details provided under section “Contact Us” below.

•      If we have collected and process your personal data with your consent, then you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal data conducted in reliance on lawful processing grounds other than consent.

•      The right to complain to a data protection authority about our collection and use of your personal data. For more information, please contact your local data protection authority.

 

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

 

If you are aware of changes or inaccuracies in your information, you should inform us of such changes so that our records may be updated or corrected.

If you are a California resident, you can make certain requests regarding your personal information. We will fulfill each of these requests per the requirements of California law.

(a)  You can request access to a copy of the personal information we have about you, including a list of categories of your personal information that we have sold and a list of categories of your personal information that we have shared with another company for a business purpose.

(b)  You can request that we delete your personal information.

(c)  You can request that we stop selling your personal information.

REQUEST MY PERSONAL INFORMATION:

If you make this request, which we also refer to as a Request to Access Information, we will return to you (to the extent required by law):

 

Ø  The categories of personal information we have collected about you.

Ø  The categories of sources from which we collect your personal information.

Ø  The business or commercial purpose for collecting or selling your personal information.

Ø  The categories of third parties with whom we share personal information.

Ø  The specific pieces of personal information we have collected about you.

Ø  A list of categories of personal information that we have sold, along with the category of any other company we sold it to. Any of the categories of personal information that we collect could be included in a sale to other companies, including those within our corporate family. You can ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to personal information we collected about you in the previous 12 months.

 

DELETE MY PERSONAL INFORMATION:

You have the right to ask that we delete your personal information. Once we receive a request, we will delete the personal information (to the extent required by law) we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. Choosing to delete your personal information may impact your ability to use our websites and online features, including closure of your online account.

 

STOP SELLING MY PERSONAL INFORMATION:

In the twelve months prior to the effective date of this Statement, we has not sold any personal information of consumers, as those terms are defined under the California Consumer Privacy Act.

NO DISCRIMINATION:

We will not discriminate against you for exercising your rights. This generally means we will not deny you using our services, provide a different level or quality of our services. Please know, if you ask us to delete your information, it may impact your experience with us, and you may not be able to participate in certain services which require usage of your personal information to function.

VERIFYING YOUR IDENTITY FOR REQUESTS TO ACCESS OR DELETE PERSONAL INFORMATION

We take the privacy of your personal information seriously and want to ensure that we provide only you or your authorized agent with your personal information. The CCPA also requires that we verify the identity of each person who makes a request to know what personal information we have about you or to delete the personal information we have about you.

III. How 4PX Collects Information

3.1 You take the initiative to provide the relevant information to 4PX, including:

3.1.1The information that you may fill in and/or submit in different ways to establish 4PX account when you establish the 4PX account, including your name, head portrait, proposed user name, e-mail, mobile phone number, and 4PX account and password.

3.1.2 The information that you fill in and/or submit the information in the different real name authentication ways based on the webpage prompt at the time of real name authentication for 4PX account.

3.1.3 The information that you fill in and/or submit in different ways based on webpage prompt when you complete 4PX account identity verification or real person authentication, including your mugshot, or video or audio recording your facial or voice information, or video or audio recording the dialogue between you and 4PX, or upper body photo that you hold your ID card, copy of ID card and identity information thereof (including your name, mugshot and ID number).

3.1.4 The information that you fill in and/or submit based on different qualification requirements when you complete 4PX account qualification, including the information about your working unit, e-mail address for work, position, qualification documents, the copy of your ID card and the identity information thereof (including your name, mugshot and ID number), your portrait and facial features, etc.

3.1.5 The information that you fill in and/or submit in order to complete your services or transactions if you are the sender, including the parcel information (including name, value/price of the commodities/ articles in the parcel), the information about the sender (including name, telephone number and address), and the information about the addressee (including name, telephone number and address).

3.1.6 The information that you fill in and/or submit in order to complete fee settlement for your services or transactions, including but not limited to your bank account and the identity information thereof (including your bank account number, name and mobile phone).

3.2 4PX will collect the relevant information when you use the services, including:

3.2.1 The information that 4PX automatically receives and records from your browser and computer when you use 4PX’s services or access to 4PX Client, including but not limited to your IP address, browser type, language, access date and time, software and hardware features, and the records about the webpage in your need; and the information in relation to the equipment location and mobile devices that 4PX automatically receives and records when you download or use 4PX Client, or access to the mobile webpage and use the services, including but not limited to the equipment model, equipment ID, operation system, resolution ratio, and telecom operator, such as the equipment information, log information, equipment location information, unique application number, local storage, Cookie or similar technical information in your use of the services.

3.2.2 Your other relevant information that 4PX might collect for reasonable needs to provide services and improve the service quality, including the relevant information that you provide when you contact the customer service team of 4PX, questionnaire information sent to 4PX when you participate in questionnaire, and the relevant information collected by 4PX when you interact with 4PX’s affiliates and logistics partners. Meanwhile, in order to improve the security when you use the services provided by 4PX Client, and more accurately prevent phishing and Torjan virus, 4PX might judge the risks of your account by knowing certain your network use habits and the software that you usually use, and might record some URL that in opinion of 4PX is risky.

3.3 Relevant information furnished by a third party to 4PX. In order to provide you with better and more personalized services, or jointly provide services to you, or prevent internet fraud, 4PX’s affiliates, logistics partners and other third parties will share your personal information with 4PX pursuant to the laws and regulations or according to the agreement with you or with your consent, including:

3.3.1 Your personal information that 4PX’s affiliates or logistics partners share with 4PX in order to complete your services or transactions, including the parcel information (including name, value/price of the commodities/ articles in the parcel), the information about the sender (including name, telephone number and address), and the information about the addressee (including name, telephone number and address) under the orders.

3.3.2 You information that might be contained in the information provided or shared by other users. E.g., if you are the addressee, the information that the sender fills in and/or submits in order to complete the proposed services or transactions will contain your name, telephone number and address.

 

IV. How 4PX Uses the Information

4.1 Provide you with the intended services.

4.2 Provide you with information display, search and services that fit more your personalized demand in order to improve the services that you use. 4PX will fetch the information about your browsing and search preference, behavioral habits and location based on your browsing and search records, equipment information, location information and order information, offer indirect population portrait based on feature tags, and display and push information and possible commercial advertising. If you do not want to receive any commercial advertising from 4PX, you may unsubscribe as directed or directly contact 4PX to cancel subscription.

4.3 In order to improve the security for your use of the services provided by 4PX, and its affiliates and logistics partners, guarantee security of the operation environment and identify abnormal state, protect your personal and property safety, and personal and property safety of other users or the public, better prevent phishing site, fraud, network vulnerability, computer virus, network attack, network invasion and other safety risks, and more accurately identify violation of laws and regulations or relevant protocols and rules of 4PX Client, 4PX might use or integrate your account information, transaction information, equipment information, relevant network log, and the information to be shared by 4PX’s affiliates and partners with your authorization or pursuant to applicable laws, comprehensively judge the risks of your 4PX account and transactions, authenticate the identity, detect and prevent safety events, and if necessary, record, audit, analyze and dispose of the events according to laws.  

4.4 4PX might conduct de-identification research, statistical analysis and prediction on the collected information, to improve the contents and layout of 4PX Client, provide product or service support to the commercial decision making, and improve the products or services of 4PX, e.g. use of anonymous data for machine learning or model algorithm training.

4.5 Unless the laws provide for mandatory retention period, 4PX only retains your personal information during the period required for the purpose under this Policy.

4.6 If 4PX uses the specific information for other purposes not set out in this Policy, or use the information collected hereunder for other purposes, 4PX will obtain your prior consent.

 

V. How 4PX Shares, Transfers and Discloses the Information 

5.1 4PX is obligated to keep confidential your personal information, and will not sell or lease any of your personal information for the marketing purposes of any third parties. 4PX will share your personal information with a third party only in the following circumstances:

5.1.1 4PX obtains your prior consent or authorization to share your personal information.

5.1.2 4PX is required to share your personal information according to laws and regulations, or the requirements of the administrative or juridical bodies.

5.1.3 4PX shares your personal information with 4PX’s affiliates. In order to make it easy for 4PX to provide services to you based on 4PX account, recommend the information that you might be interested in, identify abnormality of 4PX account, and protect your personal and property safety, and personal and property safety of other users or the public, your personal information might be shared with 4PX’s affiliates. 4PX will share the necessary personal information only, and shall observe the purpose as stated herein. If 4PX shares your personal information or 4PX’s affiliates change the use and processing purpose of the personal information, 4PX or its affiliates shall obtain your authorization again.

5.1.4 In order to make it easy for 4PX to provide better logistics services to you, 4PX might entrust and authorize its logistics partners to provide you with the logistics services or perform duty in connection with the logistics services for and on behalf of 4PX, including but not limited to sending, checking and distributing mails. 4PX will share your personal information with its reliable logistics partners, and strictly limit use by its logistics partners of your personal information. 4PX urges its logistics partners to process your personal information for 4PX according to the instructions of 4PX, this Privacy Policy and any other corresponding confidentiality and security measures.

5.1.5 If you are a qualified intellectual property right complainant and have lodged complaint with 4PX, upon request of the respondent, your personal information will be disclosed to the respondent, so that both parties could address the possible right disputes.

5.1.6 4PX may provide the services in your needs or address your disputes or controversies with others only by sharing your personal information. E.g., if you consign 4PX’s logistics partners to collect the mail through 4PX’s station, and 4PX’s logistics partners request disclosure of relevant information to perform the obligation, 4PX will submit the contact information and other necessary information of the sender/addressee to such partners so as to facilitate completion of the services.

5.1.7 If you violate the relevant Chinese laws and regulations, or the relevant protocols or rules of 4PX, 4PX shall make disclosure to a third party.

5.1.8 It is necessary to protect your personal and property safety, or the personal and property safety of 4PX and its affiliates and logistics partners, or the users or the public.

5.2 4PX will not transfer your personal information to any companies, organizations and individuals, except that:

5.2.1 With your express consent, 4PX will transfer you personal information to other parties;

5.2.2 When 4PX’s service provider is merged, acquired or bankrupt, or involved in other circumstances related to merger, acquisition or bankruptcy, if transfer of personal information is required, 4PX will urge the new companies or organizations in possession of your personal information to be bound by this Policy. Otherwise, 4PX will demand such companies, organizations and individuals to obtain your authorization again.

5.3 4PX will disclose your personal information only in the following circumstances:

5.3.1 4PX may disclose your personal information with your express consent or based on your initiative option;

5.3.2 If 4PX confirms that you violate the laws and regulations or seriously break the relevant protocols and rules of 4PX, or in order to protect your personal and property safety or the personal and property safety of 4PX’s users or the public, 4PX may disclose your personal information pursuant to the laws and regulations or with your consent, including relevant foul play and actions that have been taken by 4PX against you.

5.4 In any of the following circumstances, 4PX will share, transfer or disclose your personal information without your prior consent:

5.4.1 It is related to national security and national defense security;

5.4.2 It is related to public security, public health or the major public interest;

5.4.3 It is related to criminal investigation, prosecution, judgment, execution of judgment or other juridical or administration enforcement;

5.4.4 It aims to protect your or others’ life, property and other major legitimate rights and interest, but it hard to obtain personal consent;

5.4.5 You disclose personal information to the public on your own;

5.4.6 The personal information is collected from the information that is lawfully disclosed, such as lawful news report, government information publicity channels, etc.

5.5 Pursuant to the laws and regulations, if 4PX takes technical measures and other necessary measures to process your personal information, so that the data receiving party is unable to identify the specific individual again and the data cannot be restored, then, it is not required to give a notice to you and obtain your consent for any sharing, transfer or disclosure of the data after such processing.

VI. Information Storage and Transmission

6.1 If you use the services of 4PX outside the People’s Republic of China, your personal information may be transmitted to your country/ region/ or the country/ region where you use the services of 4PX or the country / region where you access to 4PX Client or the country/ region where 4PX collects the information, so that you could successfully use the services of 4PX or access to 4PX Client in your country / region.

6.2 As a global organization, data we collect may be transferred internationally throughout our worldwide organization. Your personal data may be exchanged with other group companies of 4PX. We exchange your data for administrative purposes and so that we can have a complete overview of your contacts and contracts within the Company group. We may also exchange your data in order to better offer you a complete package of services and products.Our employees are authorized to access personal data only to the extent necessary to serve the applicable purpose and to perform their jobs.

6.3 We ensure that the recipient of your Personal Data offers an adequate level of protection, for instance by entering into appropriate agreements and, if required, standard contractual clauses for the transfer of data as approved by the competent supervisory authority.

 

VII. Protection of Your Personal Information

7.1 In order to protect your information security, 4PX strives to take all kinds of reasonable physical, electronic and managerial security measures to protect your information, so that your information will not be disclosed, destroyed or lost, including but not limited to HTTPS protocol for transmission encryption, SSL, information encrypted storage, and data center access control. 4PX also strictly manages the employees or outsourcing personnel who might access to your information, including but not limited to different authority control based on different position, execution of nondisclosure agreement with them, monitoring of their operation, or security and privacy protection training. 4PX will provide corresponding security measures to protect your information, and provide reasonable security measures based on the existing technologies. 4PX will make efforts to protect your information from and against being disclosed, destroyed or lost. The important information system of 4PX has passed evaluation of China’s national information security classified protection, and 4PX has implemented the information security management system based on ISO/IEC: 27001 International Standard. However, the Internet is not an absolutely safe environment. No Internet transmission or electronic storage method is 100% safe. Thus, even though we protect your personal information in a commercially accepted way, we are still unable to guarantee that the information is absolutely safe.

7.2 Your account has the security protection functions. Please properly keep your account and password information. 4PX will ensure that your information will not be lost, misused and forged through backup in other server, encryption of user password and other security measures. Notwithstanding the foregoing security measures, please note that there is no “perfect security measure” in the information network. 4PX advises you to take positive actions, including but not limited to use of complicated password, regular revision of password, or nondisclosure of your account password and other personal information to others.

7.3 While using the services of 4PX, it is unavoidable for you to provide your personal information to the express service enterprise or parcel sender/ addressee or your entrusted actual parcel sender/ addressee, such as contact information or mailing address. Please properly keep your personal information, and disclose such information to others only in necessary circumstances. If you find that your personal information is disclosed, in particular to your account number and password, please immediately contact 4PX so that 4PX could take appropriate actions.

7.4 After knowing personal information security events, 4PX will inform you of the basic information and possible influence of the security events, actions that have been or will be taken by 4PX, recommendations that you might independently prevent and reduce the risks, and remedies available to you pursuant to the laws and regulations. 4PX will inform you of the relevant conditions of the events by mail, letter, phone or pushing notification. If it is hard to inform the personal information subjects one by one, 4PX will publish an announcement in a reasonable and effective way. Meanwhile, 4PX will report disposal of the personal information security events according to the requirements of the regulatory bodies.

VIII. Management of Your Personal Information

8.1 Inquiry and updating of your personal information

8.1.1 If you have to inquire about your personal information in 4PX account, you may directly login to 4PX Client, and check “My Personal Information” to inquire about your name, head portrait, proposed user name, e-mail, telephone number and 4PX account; if you have completed 4PX account real name authentication, you may also inquire about the information that you fill in and/or submit at the time of real name authentication in the way mentioned above; if you have completed 4PX account identity verification or real person authentication, you may also inquire about the information that you fill in and/or submit at the time of identity verification or real person authentication in the way mentioned above; if you have completed 4PX account qualification, you may also inquire about the information that you fill in and/or submit at the time of qualification in the way mentioned above. If you are unable to inquire about your personal information, you may directly contact 4PX.

8.1.2 In case of changes to your information submitted in registration of account or use of 4PX Client, you may directly login to 4PX Client, and click “My Personal Information” to update your personal information. If you are unable to update your personal information, you may directly contact 4PX.

8.2 Deletion of your personal information 

8.2.1 In any of the following circumstances, you may give a request to 4XP for deleting your personal information in 4PX account based on the contact information of 4PX as set out in Section XII hereof.

8.2.1.1 Processing by 4PX of personal information violates the laws and regulations;

8.2.1.2 4PX collects and uses your personal information without your express consent;

8.2.1.3 Processing by 4PX of personal information seriously violates the agreement with you;

8.2.1.4 You do not use the services of 4PX any longer, or your 4PX account has been cancelled according to the account cancellation procedures of 4PX;

8.2.1.5 4PX does permanently not provide you with any products or services.

8.2.2 If 4PX decides to respond to your request for deletion, 4PX will also inform the subjects that receive your personal information from 4PX as far as possible, and demand them to delete your personal information in time (unless otherwise stipulated by laws and regulations, or such subjects have independently obtained your authorization).

8.2.3 After you or 4PX assists you to delete the relevant information, 4PX might be unable to delete the corresponding information from the backup system immediately due to applicable laws and security technology. In this case, 4PX will safely store your personal information and separate such information from any further processing, until the backup can be deleted or become anonymous.

8.3 Withdrawal of consent

If stipulated by laws, you may withdraw your consent previously given to us, and have the option to exit any marketing information. In specific circumstances, you have the right to restrict our processing of your data or oppose any processing of your personal data at any time for legal grounds related to your situation. Withdrawal of your consent will not affect the legitimacy of any of our processing before your withdrawal, nor affect any processing of your personal data based on any legal grounds other than consent.

8.4 Cancellation of the account

You may give a request to 4PX’s customer service staff [Tel.: 0755-23508077] for cancelling the account. After you cancel the account, we will stop providing you with any products/ services. Except otherwise stipulated by laws and regulations, we will delete or anonymize your personal information.

 

IX. Use of Cookie, Network Beacon and Cookie Similar Technologies

9.1 Cookie

9.1.1 In order to facilitate your access experience, when you access to 4PX Client or use the services, 4PX may identify your status through small data file, which will help you to avoid repeated entry of the account information or help you to judge security of your account. These data files may be Cookie, Flash Cookie, or other local storage provided by your browser or the affiliated applications (collectively referred to as “Cookie”).

9.1.2 Please understand that certain services of 4PX may be realized only through “Cookie”. If your browser or additional services of the browser permit, you may revise the acceptance level of Cookie or refuse the Cookie of 4PX. You may clear all Cookie kept in the computer. Most browsers have the function to block Cookie. However, if you do so, you have to revise the user settings in person whenever you access to our website. 9.2 The webpage of Network Beacon generally contain some electronic images (referred to as “single-pixel” GIF file or “network beacon”). Use of network beacon may help the website to calculate the users browsing the webpage or access to certain cookie. 4PX will collect the information related to your browsing of the webpage via the network beacon, such as the address of the webpage that you visit, the address of the link webpage that you previously visited, staying time on the webpage, your browsing environment and display settings, etc.

9.3 Apart from Cookie, 4PX will also use website beacon, pixel tag, Etag and other similar technologies. E.g., e-mail sent by 4PX to you might contain linkage to the contents of 4PX Client. If you click such linkage, 4PX will trace this clicking and help 4PX to know your product or service preference, so that 4PX takes the initiative to improve the customer service experience. Website beacon is generally a kind of transparent image that is embedded in the website or e-mail. By virtue of the pixel tags in the e-mail, 4PX is able to know whether the e-mail has been read or not. If you do not expect to be traced through your own activities in this way, you may unsubscribe the mail list of 4PX at any time. ETag (entity tag) is header of HTTP Protocol between the Internet browser and the Internet server, and can substitute Cookie. ETag may help 4PX to avoid unnecessary server load, improve service efficiency, and save resources and energy. Most of browsers have the function to clear the browser caching data for the users. You may clear the data accordingly in the setting function of the browser. However, please note that if ETag is disabled, you might be unable to enjoy relatively better product or service experience.

X. Protection of Minors

We attach great importance to protection of the personal information of the minors.
